Terms of booking: Ab Tempus R&H Oy
Ab Tempus R&H Oy (hereinafter “Tempus” and “owner”) applies the following terms and conditions to the leasing of its cottages. These terms and conditions become binding to both parties when the client has paid Tempus according to the instalment mentioned in the contract terms.
Booking and payment terms
The person doing the booking must be of legal age when doing so, i.e. at least 18 years old.
The booking can be done through the booking service on our web pages, where after the booking confirmation is sent to our clients e-mail. The booking is considered confirmed once the client has payed the entire invoice and once the owner has sent a booking confirmation to the client.
The final invoice contains the address of the cottage owner (Tempus), which also is the place where the client has to pick up the key to the cottage.
If the client does not pay, Tempus might cancel the booking without any further notice.
In case of double booking and other booking errors
In case of possible double booking while the client is in the process of making their cottage booking, the owner will refund the entire amount to the client. Sometimes other problems can arise during the booking process for example, a error is made in the price information or the dates that are selected are not available, other types of errors could be technical. In case of these types of booking errors the client will be informed by the owner through email and the client and owner will discuss how they plan to resolve the error. If the client and owner do not agree on a resolution to the error than the full amount is refunded to the client and the booking is canceled.
Cancelling and changing the booking
A booking can be cancelled by sending Tempus an e-mail if it is more than 40 days until the start of the rental period (please make sure you get a confirmation from Tempus in case of cancellation). When a booking is properly cancelled with at least 40 days notice the client will get refunded on the entire amount of their booking.
If the client cancels his booking less than 40 days before the start of his/her holiday nothing will be refunded. If however, the client renting the cottage or someone in his/her immediate family gets severely sick or dies, the client has the right to get refunded on the final instalment even if the cancellation is done less than 40 days before the start of the holiday. This form of cancellation requires a doctor’s certificate.
Tempus right to cancel the booking
In situations of force majeure (fire, natural disaster etc.), Tempus has the right to cancel any booking and the client has the right to get refunded on the whole amount.
If a booking has to be cancelled because of the client’s disruptive behaviour no refunds are given.
If the client does not pay on time, Tempus might cancel the booking without any further notice.
Tempus might also cancel a booking before final confirmation, if there is a double booking, and the other booking has been in place before the new booking. If this happens the client is entitled to full refund.
About staying at our cottages
The cottage will be at the client’s disposal from 4pm on the day of arrival until 12 noon on the day of departure. In the case of a weekend stay, the cottage is in the client’s disposal until 6pm on Sunday evening.
The cottage keys will be handed over to the client at the time of arrival as estimated and notified to the owner by phone or in writing.
The rent entitles the client to use the cottage during the booked period. Normal energy consumption, furnishings, cooking and eating utensils, mattresses, blankets and pillows, and firewood are included in the rent. Dish-washing detergents, basic spices and well as kitchen and toilet rolls are not included in the rent.
Sheets and towels are not included in the rent unless otherwise stated in the cottage description. Guests must use bed linen. Sheets and towels can be ordered for a separate fee in conjunction with the booking.
The client is responsible for cleaning the cottage during the rental period and on departure, unless something else has been agreed on during booking. Final cleaning can be ordered for a separate fee in conjunction with the booking.
The number of people using the cottage must not exceed the number of sleeping places stated in the cottage description, unless something else has been agreed on during booking.
Pets are not allowed at the cottages. For special arrangements and allowances please contact the owner.
Smoking is prohibited indoors.
Obligations of the client and handover of the destination on the day of departure
The client will hand over the cottage and its keys at 12 noon on the day of departure unless something else has been agreed. Weekend booking hand over is done at 6 pm on Sunday. If the client plans on leaving earlier it must be communicated clearly to the owner, so that the cottage can be inspected before departure.
Clients are liable for any damages caused to the property and the owner must be notified immediately if any damage has been caused. The client should compensate any damage directly to the owner of the property.
Smoking is prohibited in all cottages and the cottage must be tidy on departure. The client is liable to compensate the expenses of cleaning the cottage if guests have smoked indoors or if the cleaning of the cottage has not been done appropriately.
The separately ordered; “Final cleaning” does not cover dish-washing and garbage removal. The client must also remove all empty bottles and cans from the property and put the furniture of the cottage in the places they originally were.
Force majeure
Tempus will not be liable for any damage or inconvenience incurred by the client in the event of an unpredictable and insurmountable obstacle (force majeure) or some other comparable reason (such as a power failure, or natural phenomena like algae blooms or the occurrence of animals like mice or insects) that was not caused by Tempus and whose effects Tempus could not be reasonably expected to prevent. Neither is Tempus responsible for any damage or inconvenience caused by regular natural phenomena.
Objections and complaints
All objections and complaints regarding the rented cottage have to be made immediately, once the cause arises, to the owner.
If the client does not immediately report observed deficiencies to the owner, the cottage can be considered being in the contractually-required condition. Tempus is not liable to compensate for deficiencies reported for after the rental period.
Applicable law and venue for the resolution of disputes
The contracting parties will attempt to resolve any disputes out of court. Should they fail to reach agreement, any disputes will be settled by the local court; “Egentliga Finlands tingsrätt”. The contract is governed by Finnish law.
